TERMS AND CONDITIONS

1. SCOPE OF APPLICATION
These terms and conditions apply to all contracts concluded through our online shop between Niflheim Records (Luis Alfredo Godoy Alvarez) and our customers.

 

2. CONTRACT CONCLUSION
A contract is concluded when you place an order and we confirm it via email.

 

3. PRICES AND PAYMENT

  • All prices are final prices and include VAT where applicable.

  • Payment methods:

    • PayPal

    • Credit card

    • Bank transfer

 

4. SHIPPING

Shipping costs and delivery times are outlined in detail in our Shipping & Returns policy, which forms an integral part of these terms.

 

5. RIGHT OF WITHDRAWAL
Customers have the right to withdraw from the contract within 14 days, as described in our Shipping & Returns policy.

 

6. LIABILITY
We are liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded, except in cases of harm to life, body, or health.

 

7. GOVERNING LAW
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

Additional information for the “Sleipnir Grade” app

1. Controller

 

The controller responsible for data processing in connection with the mobile app “Sleipnir Grade” is:

2. What data does the app process?

The app processes the following categories of data:

  • Data you enter in the grading wizard: information you enter manually, such as artist, title, condition of cover, vinyl, inner sleeves, extras, and any free-text notes (for example matrix notes or comments about defects).

  • Grading data: automatically calculated grading suggestions (for example “Media: VG+”, “Sleeve: VG”) and the generated description texts.

  • Photos (optional): if you add photos in the app, these photos are stored only locally on your device. In the current version of the app these photos are not uploaded to external services.

  • Technical information: in limited cases, technical information such as app version and language may be sent when calling the AI service.

3. Purposes and legal bases

We process the above data in order to provide the functions of the app, in particular:

  • to run the step-by-step grading workflow

  • to generate formatted description texts using an external AI service

  • to store and manage your graded records locally on your device

  • to provide optional export functions (text, CSV, JSON, Markdown)

The legal bases for this processing under the GDPR are:

  • Article 6(1)(b) GDPR (performance of a contract), where the processing is necessary to provide the app features you request, and

  • Article 6(1)(f) GDPR (legitimate interests), where we have a legitimate interest in providing and improving a practical grading tool. We take care to balance our interests with your rights and freedoms.

We do not use data from Sleipnir Grade for marketing profiles, personalised advertising or resale.

4. Disclosure to third parties / external services

 

To generate the automatic description texts, the app uses an external AI service. At the time of writing we use the OpenAI API (openai.com).

When you trigger the “Finish & Grade” function, the relevant text inputs and grading data are transmitted to OpenAI in order to generate the listing text. The transmission takes place via an encrypted connection (HTTPS).

We do not store this transmitted content on our own servers. Any further processing or storage by OpenAI is carried out under their own responsibility. Please refer to the OpenAI privacy documentation for details about their processing and retention.

5. Storage period

  • The data you store in the app (grades, notes, photos) remains on your device until you delete it in the app or uninstall the app. When you uninstall the app, the local data is removed by the operating system.

  • Data transmitted to the AI service is processed to generate your listing text. We do not store this data separately. Any storage by OpenAI is subject to their own policies.

6. Your rights

You have the rights described in this Privacy Policy (right of access, rectification, erasure, restriction of processing, data portability, objection), subject to the legal requirements.

Please note that we do not operate central user accounts or a cloud-based storage for Sleipnir Grade. Many of your entries exist only on your device and can be removed by deleting individual records or uninstalling the app.

If you believe we process personal data about you on our own systems in relation to Sleipnir Grade and you wish to exercise your rights, you can contact us at kontakt@niflheimrecords.de.

You also have the right to lodge a complaint with the data protection authority that is competent for your place of residence.
